Privacy Policy for Broyce Control NFC Apps

1. About this policy

This privacy policy explains how Broyce Control Ltd (“Broyce Control”, “we”, “us” or “our”) handles information in connection with the following Android applications (together, the “Apps”):

  • LPRC/2-NFC;
  • LMMT/2-NFC; and
  • ELR-NFC.

The Apps are companion applications for configuring, reading and, where supported, monitoring compatible Broyce Control products using Near Field Communication (NFC).

This policy applies only to the Apps. It does not apply to the Broyce Control website or to any third-party website, service or application that may be linked from an App.

3. Summary

The Apps do not require an account and do not collect, transmit to Broyce Control, sell or share personal or sensitive user data. The Apps communicate locally with compatible Broyce Control products using NFC. Product settings, status information and logs read by an App are not sent to Broyce Control.

4. Information handled by the Apps

4.1 Personal data

The Apps do not collect or transmit personal data to Broyce Control. In particular, the Apps do not collect:

  • names, postal addresses, email addresses or telephone numbers;
  • account or login details;
  • precise or approximate location;
  • contacts, photographs, videos, audio or other files stored on the device;
  • advertising identifiers or information used for advertising or tracking;
  • payment or financial information; or
  • health or other sensitive personal data.

We do not use the Apps for advertising, behavioural tracking, profiling or automated decision-making.

4.2 NFC and product information

The Apps use the NFC capability of the Android device to communicate directly with compatible Broyce Control products. Depending on the product and App, this may include reading or writing:

  • product configuration parameters and operating settings;
  • product type, firmware or configuration information;
  • relay, timer or protection settings;
  • product status and measured values; and
  • product event or trip logs.

This exchange takes place locally between the Android device and the Broyce Control product. Broyce Control does not receive or remotely store this information through the Apps. Any App information stored on the Android device remains under the user’s control and can normally be removed by clearing the App’s storage or uninstalling the App.

4.3 Device permissions

The Apps use Android functionality required for NFC communication. A permission is used only to provide the relevant App feature. The Apps do not use device permissions to collect personal data for Broyce Control, advertising or tracking.

5. Why the Apps handle information

The Apps handle product information only to provide the functions requested by the user, such as reading a product, displaying its current configuration or status, changing settings and writing a configuration back to the product. Because this processing occurs locally and the information is not transmitted to Broyce Control, Broyce Control does not retain it on its systems.

6. Sharing of information

The Apps do not send personal or product information to Broyce Control and do not share such information with third parties. We do not sell information obtained through the Apps.

When an App is downloaded or updated through Google Play, Google may process information as an independent service provider or data controller. That processing is governed by Google’s own privacy policy and is not controlled by Broyce Control.

7. Technical support and other direct contact

If a user contacts Broyce Control for technical support or another enquiry, we may receive the contact details and other information that the user chooses to provide, such as their name, email address, telephone number, company, product details, diagnostic information and the contents of their message. This information is provided directly by the user and is not collected automatically by the Apps.

We use this information to:

  • respond to the enquiry and provide requested support;
  • investigate faults and improve our products and Apps;
  • maintain appropriate records of support provided; and
  • establish, exercise or defend legal claims, where necessary.

Our lawful basis will normally be our legitimate interests in providing support and improving our products, or taking steps at the user’s request before entering into or performing a contract. We may also process information where necessary to comply with a legal obligation.

Support information may be made available to employees, professional advisers and service providers who need it for these purposes and who are subject to appropriate confidentiality and data-protection obligations. We do not sell support-enquiry information.

8. Retention and deletion

Broyce Control does not retain personal or product information through the Apps because the Apps do not transmit that information to us.

Information stored locally by an App can normally be deleted by clearing the App’s storage or uninstalling the App. Uninstalling an App does not alter information that has already been written to a Broyce Control product.

Information supplied in a support enquiry is retained only for as long as reasonably necessary to deal with the enquiry, maintain appropriate business and support records, comply with legal obligations, and establish, exercise or defend legal claims. It is then securely deleted or anonymised in accordance with our retention procedures.

A user may ask us to delete personal data supplied in a support enquiry by contacting [email protected]. We will comply unless we have a lawful reason or obligation to retain it.

9. Security

We take appropriate technical and organisational measures to protect personal data provided directly to us against accidental or unlawful loss, alteration, disclosure, access or destruction. No method of electronic storage or transmission is completely secure, but we review our measures and update them where appropriate.

10. International transfers

The Apps do not transmit personal or product information to Broyce Control, so the Apps do not cause Broyce Control to transfer that information internationally. If information provided in a support enquiry is processed outside the United Kingdom, we will use an appropriate safeguard as required by applicable data-protection law.

11. Children’s privacy

The Apps are technical tools intended for adults and trained persons configuring or monitoring industrial electrical products. They are not directed at children, and we do not knowingly collect personal data from children through the Apps.

12. Your data-protection rights

Where Broyce Control holds personal data about a user, the user may have rights under the UK GDPR and other applicable data-protection laws. Depending on the circumstances, these may include the right to:

  • request access to their personal data;
  • request correction of inaccurate or incomplete personal data;
  • request deletion of personal data;
  • request restriction of processing;
  • object to processing based on legitimate interests;
  • receive certain personal data in a portable format; and
  • withdraw consent at any time where processing is based on consent.

These rights are not absolute and may be subject to legal conditions or exemptions. Requests can be made using the contact details in section 14.

Users also have the right to make a complaint to the UK Information Commissioner’s Office (ICO). Information is available at ico.org.uk/make-a-complaint. Users outside the United Kingdom may also have the right to contact their local data-protection authority.

13. Changes to this policy

We may update this policy if an App, our practices or applicable legal requirements change. The latest version will be published on this page, and the effective date at the top will be updated. If a change materially affects how personal data is handled, we will provide additional notice where required.
